In 10 years since founding the Toby Center for Family Transitions, and during the 20 years working in the field, Dr. Roseman has found that children whose parents have legal counsel have the best outcomes. It is vital for courts to be reminded that parents in the 'heat' of argument is not the ideal time to make determinations. Parents would do best to find therapy and support groups to help them adjust during these very challenging times.

Field Monitors are obligated to provide reports for use by the parties and the Courts for adjudging the value and process of the SVN. Field reports provide descriptive information helpful to judges, GALs, and Case Managers on custody and access determination.

What Courts Should Know About The Toby Center

  • The Toby Center is neutral — we do not advocate for either parent. Our role is to support children and facilitate safe, meaningful contact.
  • Field Monitors are frequently subpoenaed to appear during litigation. It is not the Field Monitor who makes any determinations for continuing or modifying court orders.
  • The Toby Center provides supportive visitation services — staff members do not merely sit and observe. We actively assist children who are fearful or withdrawn, and parents who are anxious.
  • Our goal is that of the Court: to bridge the vacuum or space between the child and their noncustodial parent and foster a trusting and loving relationship.
  • We serve clients across Florida, Connecticut, and Massachusetts and can coordinate with courts in each jurisdiction.
  • A court order is not always a necessity. There does need to be an agreement between the parents for time, frequency, and financial responsibility.

What Attorneys Should Know

As a parent, as most parents, we wish only for good things for our children. In order for children to achieve their best outcomes, children need access and time with both parents — not one, but both. This is what the research says. Research shows us that court orders for custody may positively affect or negatively impact a family for up to six generations.
Nearly 40% of parents represent themselves in family court. Many parents may not be readily familiar with mechanisms within the Court. Legal Representation is often best for obtaining satisfactory child custody and visitation outcomes. Many courts provide a Self-Help office where litigants may schedule a short period of time with an attorney.
Mediation is not necessarily an alternative to court, but it is a most important procedure for both parents to determine their own future, and that of their children and family for years to come. A good mediator should facilitate, not order parents toward joint decision making. Mediators should be trained in consultative, mindful approaches. Some states certify mediators and include attorneys, licensed therapists, social workers, and family practitioners.
Supervised Visitation is scheduled parenting time with a child that is facilitated by a third party. Most often court ordered when a parent is alleged to have been engaged in domestic violence, drug and alcohol abuse, or has been absent a long time from the home and the child's life. The Toby Center provides supportive visitation services — staff actively assist children who are fearful or withdrawn, and parents who are anxious during these very unnatural, monitored time sharing sessions.
Unlike other human service agencies, Toby Center staff understands parental alienation. The Toby Center provides reunification therapy, family court mediation, and therapeutic supervised visitation services specifically designed to address the dynamics of parental alienation and child estrangement during custody disputes.
